Asimismo, es dable diferenciar entre las razones dirimentes -que conforman la ratio decidendi u holding- y aquellas que son consideradas secundarias, debido a que no sostienen la decisión o fallo: las razones a mayor abundamiento. El objetivo de este trabajo consiste en presentar, a partir del análisis de un caso correspondiente a un corpus de sentencias pronunciadas por la Suprema Corte de Justicia de la provincia de Buenos Aires (SCBA), lo que denominamos uso (meta)argumentativo exegético de la expresión "a mayor abundamiento", es decir, cuando la SCBA reflexiona sobre "cómo debería ser" y "cómo no debería ser" el empleo de estos argumentos colaterales o de apoyo a la decisión. De este modo, este máximo tribunal provincial imparte una "enseñanza" a los destinatarios de sus sentencias, dado que, al mismo tiempo que fundamenta sus decisiones y valora la pertinencia de este tipo de argumentos en sentencias emitidas por otros tribunales de instancias inferiores -hora recurridas y objeto de una nueva resolución por parte de esta Corte- explica cuál es el significado y alcance de estas razones introducidas "a mayor abundamiento". | |

Moreover, a further distinction can be made between the elements on which the decision is founded - which form the ratio decidendi or holding - and those which are considered secondary in that they do not hold the decision or judgment: the a mayor abundamiento reasons or further arguments. The aim of this paper is to present, based on an analysis of a case belonging to a corpus of decisions issued by the Supreme Court of Justice of the Province of Buenos Aires (SCBA), what we have called the (meta)argumentative exegetic use of the phrase "a mayor abundamiento"; in other words, when the SCBA ponders on "the way" these side or supporting arguments "should or should not be used" in a decision. Thus, the highest provincial court "teaches" the addressees of their own decisions since, while providing the foundations for their own decisions and assessing the appropriateness of these kinds of arguments in judgments passed by other lower courts - now appealed and subject to a new decision made by this Court - the SCBA also explains the meaning and range of these reasons introduced as "a mayor abundamiento". | |
