La autonomía de la voluntad asumió un rol protagónico, desplazando al orden público como principio rector de la materia. De esta manera, son los futuros cónyuges quienes, en ejercicio del derecho de opción, se convierten en los responsables de elegir el régimen que consideren más conveniente para regir sus relaciones patrimoniales, teniendo en cuenta las necesidades propias de cada matrimonio en un momento determinando y contando, además, con la posibilidad de modificarlo con posterioridad, en caso de que así lo decidan. Este trabajo constituye una adaptación de la tesis de posgrado denominada: “La posibilidad de elegir el régimen de bienes al momento de la celebración del matrimonio, que rige desde la sanción del Código Civil y Comercial hasta el año 2020, en la ciudad de Salta y su aplicación”. The property regime of marriage was, without a doubt, one of the areas of marriage law that underwent major modifications with the reform of the Argentine Civil and Commercial Code. The autonomy of the will assumes a leading role, displacing public order as the governing principle of the matter. In this way, it is the future spouses who, in exercising the right of option, become responsible for choosing the regime that they consider most convenient to govern their property relations, taking into account the needs of each marriage at a time, determining and also having the possibility of modifying it later, if they decide to do so. In the city of Salta, the choice of the property regime constitutes a right that is rarely exercised by the contracting parties due, among other reasons, to their ignorance, to the formal requirements before the Civil Registry and to customs and beliefs of a conservative and traditionalist province.
