La libertad, como principal bien jurídico del hombre,  desde los inicios del Derecho ha conjugado con los avances que,  sobre la privacidad,  ha efectuado la esfera de lo público a través de sus diversas manifestaciones de poder.  Este trabajo se propone un esbozo desde los orígenes en Derecho Romano de las configuraciones de lo público y privado, para destacar los desafíos y posibles riesgos que las tecnologías disruptivas pueden presentar.   Abstract: Gaius, in his classifying desire, makes the summa divisio of people in his Institutions, stating that all men are either free or slaves. Freedom, as man's main legal asset, since the beginning of the Law has been combined with the advances that, on privacy, the public sphere has made through its various manifestations of power.  This work proposes an outline from the origins in Roman Law of the configurations of public and private, to highlight the challenges and possible risks that disruptive technologies can present.
