| Sumario: | ¿Existe conexidad entre la romana “iniuria” y la actual “antijuricidad” prevista en el artículo 1717 del Código Civil y Comercial de la Nación? El presente estudio pretende, en efecto, dar respuesta al mencionado interrogante. De la respuesta dependerá, en cierto modo, la vigencia de la tradición romanista en el nuevo Cuerpo de derecho civil.
ABSTRACT: Is there an unavoidable connection the Roman “iniuria” and the current “illegality” provided for in article 1717 of the Civil and Commercial Code of the Nation? The present study aims, in effect, to answer the aforementioned question. The validity of the civil law tradition in the new Body of civil law will depend, to a certain extent, on the answer. |
