Sumario:The present article tells about a theorist issue referent to the State and its practical perspectives inserted dynamics of a specific social movement: La Via Campesina. Supported in a critical approach referring to the State in the capitalist society, the text draws a consciousness that the state apparatus is headed to the breeding of the system, i.e. of the capital. The search is for an empiric substrate a locus to better apprehend the conception of State in the social movements here reified as Via Campesina or Peasant Way, international movement, with analyzes from the Brazilian reality, whose period is 1993-2013. Is used too bibliographic review and primary sources. With analysis, we may conclude that the social movements can focus on public policy for the population. However, under the limits of the capitalist society, the State do not constitute itself in a popular characterized institution.
