Sumario:This research aims to identify impediments to marriage that exist in Roman Law and in the current Brazilian legal system and which are made more flexible in certain famous cases. Examples are the cases of Agrippina “the Younger”, in the Roman period, and of Congresswoman Flordelis, in the present day in Brazil. The methodological path followed includes bibliographical research, jurisprudence analysis and comparative method. Norms are identified in the Institutes of Gaius, in Justiniano's Digest, in the Ordinances of the Kingdom of Portugal, in Canon Law, in the Brazilian Civil Codes, in the Brazilian Penal Code, and in the Brazilian Federal Constitution. The comparative analysis of the results shows similarities and differences in such norms. A discussion of the validity of the grounds for such impediments checks for possible reasons for violations or relaxations.
