description The Ministry of Public Works and Transportation (MOPT) of Costa Rica is one of the entities with the highest degree of administrative deconcentration. The MOPT and its deconcentrated agencies in Councils define the policies and actions of the sector. This paper analyzes the situation of the country as a signatory of the Decades of Action for Road Safety, proposed by the UN. In order to show as an example and discuss its importance as a road safety policy, the case of the specialized agency called Road Safety Council - Cosevi, created in 1979, is described, analyzed and contextualized. The changes in the institutional definition of the administration and management of the agency are studied. It is analyzed how these changes and the administrative legal practice impact the concept of leading institution in road safety and its systemic approach, considering both the integral concept of the joint action of engineering, enforcement and road education, as well as the postulates of the First Decade in terms of management, which have been blurred in the Second Decade. Finally, the relevance of the law propose 23114 is discussed, as it is a proposal that goes against the concept of management through the existence of a leading agency, and that would concentrate the functions under analysis in the MOPT. It also shows the current statistical panorama and makes recommendations for road administration in general and for the actual consolidation of Cosevi in its operational and management components.

El Ministerio de Obras Públicas y Transportes (MOPT) de Costa Rica es una de las entidades con mayor grado de desconcentración administrativa. El MOPT y sus órganos desconcentrados en Consejos definen las políticas y acciones del sector. En este trabajo se analiza la situación del país como firmante de los Decenios de Acción para la Seguridad Vial propuestos por la ONU. Con el objetivo de mostrarlo como ejemplo y discutir su importancia como política de seguridad vial, se describe, analiza y contextualiza el caso de la agencia especializada denominada Consejo de Seguridad Vial (Cosevi), creada en 1979. Se estudian los cambios operados en la definición institucional de la administración y la gestión del organismo. Se analiza cómo esos cambios y la práctica legal administrativa impactan el concepto de institución líder en seguridad vial y su enfoque sistémico, considerando tanto el concepto integral de la acción conjunta de la ingeniería, la fiscalización y la educación vial como los postulados del Primer Decenio en lo que respecta a la gestión, los cuales han quedado desdibujados en el Segundo Decenio. Finalmente, se discute la pertinencia del proyecto de ley n.° 23.114, por ser una propuesta contraria al concepto de gestión mediante la existencia de una agencia líder, y que concentraría las funciones analizadas en el MOPT. También se presenta el panorama estadístico actual y se hacen recomendaciones para la administración vial en general y para la consolidación real del Cosevi en sus componentes operativos y de gestión. Neste trabalho, analisa-se a situação do país como signatário dos Decênios de Ação para a Segurança Viária propostos pela ONU. Com o objetivo de apresentá-lo como exemplo e discutir sua importância como política de segurança viária, descreve-se, analisa-se e contextualiza-se o caso da agência especializada denominada Conselho de Segurança Viária (Cosevi), criada em 1979. Estudam-se as mudanças ocorridas na definição institucional da administração e gestão do organismo. Analisa-se como essas mudanças e a prática legal administrativa impactam o conceito de instituição líder em segurança viária e seu enfoque sistêmico, considerando tanto o conceito integral da ação conjunta da engenharia, fiscalização e educação viária quanto os postulados do Primeiro Decênio no que diz respeito à gestão, os quais se tornaram difusos no Segundo Decênio. Finalmente, discute-se a pertinência do projeto de lei 23114, por ser uma proposta contrária ao conceito de gestão mediante a existência de uma agência líder, que concentraria as funções analisadas no MOPT.
