| Sumario: | The present work analyses a sentence obtained by a commission of the\ninternship programme of the Universidad de Buenos Aires and that constitutes a precedent\nof the subject in the context of a judicial process initiated through a writ of amparo.\nFirstly, there is a description of the facts that originated the judicial process and\nafterwards analyze the admissibility estimations of the writ of amparo. Then the essay\nworks on the thesis in favor and against the constitutionality of the date of expiration.\nSubsequently there is an exam of the position assumed by the Supreme Court in the\ncase Mosqueda. Finally, the work ends up with a reflection about the binding character\nof a plenary sentence and the statement of the Supreme Court, analyzing the overview\nof the subject. |
