| Sumario: | This article aims to investigate the materialization of the double standard in the protection and promotion of human rights at regional and international levels. Our analysis will focus on the legal definition, historical development, and legal aspects of the double standard in human rights and how these practices undermine the credibility of competent regional and international mechanisms and affect the perception of justice and fairness in the global community. First, the motives and justifications behind this phenomenon will be examined to provide a deeper understanding of its implications and consequences in the effective defense of human rights. Additionally, it will be examined whether the selective use of the double standard can be considered a violation of the principle of non-discrimination if it constitutes a true challenge to the universal principles of human rights. Finally, some debates related to the double standard in the Inter-American, European, and African protection systems will be evaluated, allowing us to assess the correspondence between the theoretical analysis and its concrete impact on reality, seeking to find the best practices to effectively address this issue and enhance the interaction between States, citizens, and international organizations |
