Sumario:The purpose of this article is to navigate on other disciplines of the social sciences that assist the Law in order to resolve a jurisdictional conflict through which human rights are exercised. In this specific case, a migrant and ethno-religious community in Mexico goes to the electoral justice to request to be considered as equivalent to an indigenous or native people and, as a consequence, be able to regulate themselves under their own rules, self-government, uses and customs. An analysis is made of how law operators can turn to anthropology to act as an interlocutor between a petitioning community and a court. In addition, a critique is made of the traditional argumentative methods used in rulings and a proposal is made to discover a communicative justice that is close to all citizens
