| Sumario: | The research takes a tour of all the jurisprudence issued by the United Nations Human Rights Committee on forced disappearances, from its very first case resolved until the end of 2016. Through the study of the views and individual opinion issued, it critically examines aspects related to the elements of forced disappearance, its comprehensive approach, issues of admissibility, the rights involved, the state obligation to investigate forced disappearances, the need to adapt the domestic legal framework in accordance with international standards, the concept of victim, the gender dimension, and reparations. The investigation ends with an assessment of the positive and negative aspects of the work of the Human Rights Committee, examining individual cases of enforced disappearances under the Optional Protocol to the International Covenant on Civil and Political Rights. |
