Sumario:In the context of its return to democracy, South Africa decided to confront its past by resorting to an original formula that departed from the judicial route through the creation of a Truth and Reconciliation Commission charged with seeking the truth,assessing the reparations due to victims and deciding on the immunity from prosecution of persons who agreed to cooperate with the commission by acknowledging the violations of which they had been the perpetrators and admitting their responsibility. The purpose of this paper is to examine the third aspect, related to judicial immunity as amnesty, in order to examine the salient aspects of a particular experience that allows us to reflect on the achievements and obstacles of these processes.
