Sumario:The AI era forces us to reflect on a new paradigm that has been brewing for some time in the life of States. Thus, the advent of technology produced a gradual transformation in the operating rules of society, such as "dataism", which have created a new informational dimension (infosphere), thus modifying the way in which humans conceive and they relate to reality. This advance is currently changing the world: semi-autonomous and autonomous vehicles, increasingly powerful laptops, smartphones that can almost replace a computer in most of its functions, transport passes and bank cards with smart chips, wearable devices, household appliances smartphones, voice assistants, robots with built-in AI, e-commerce platforms, geolocation systems, delivery apps, etc. All these devices emit a huge amount of data from their users, raw information from which patterns, trends and patterns of consumption can be extracted. All this reality was not alien to the electoral field. In this sense, political parties and candidates began to use social networks more and more to reach voters, mobilize support and raise funds; while voters use them to get involved in campaigns and draw the attention of political leaders and other citizens to problems related to the elections. Thus, the resources allocated to advertising on digital platforms went from almost 5 % in 2011 to 41 % in the 2021 legislative elections (cf. data from the National Electoral Chamber). Some consider that the implementation of new technologies in the electoral political field contributes to the strengthening of a participatory democracy by having a more active citizenry, but we will also find those who "without being against" are concerned about the abuses that can originate with the malicious use of those that could break confidence in the integrity of the electoral processes. The truth is that, whether we place ourselves in any of the positions described above, the influence that AI is having throughout the world in the political-public arena and therefore in elections cannot be ignored. Now, how do they play in the field of AI, the fundamental rights of political participation? Can these concepts be harmonized? Do they weaken or strengthen the institutional system? Hence, it is necessary to study the various international experiences on the matter, since this is a topic that has been gaining presence and ground both in America and in Europe.
