Sumario:The starting point is the axiomatic statement that law is an effective technique for the organization of society. The State arises by agreement between people to cease a first primitive state of war between all human beings. Disputes may arise from the management of power of a social sector against the established social organization. That is one of the key points I address in this paper, which aims to give an integrative response of Law (emphasizing Criminal Law) and Psychoanalysis analyzing the instances of human psychic functioning (considering both individual point of view and group behavior) in contrast to the exercise of punitive power. In addition, guilt will be addressed from the Law and Psychoanalysis. An integrative dialectic of Law and Psychoanalysis becomes necessary in the justice system to remedy the problem of the law operators who fail to remove the exclusive observance of the legal system itself, as if the problem and the solution were only there.
