| Sumario: | In October 1856, a case of great importance occurred in San Isidro and attracted the attention of Buenos Aires society. However, this criminal case would go on to play a decisive role in the process aimed at abolishing the death penalty despite the few executions recorded by provincial statistics. This paper deals with the history of law, the debate on the death penalty in the State of Buenos Aires in the second half of the 19th century. The hypothesis that arises is that the murder of the painter Jacobo Fiorini by his wife Clorinda Sarracán and her accomplices produced a controversy in the political and academic elite about the abolition of capital punishment. As a second hypothesis, it is proposed that this case inspired Carlos Tejedor to exempt women from the death penalty in his Penal Code Project |
