| Sumario: | Title: The dialogue between the European Court of Human Rights and the National Constitutional Courts for the protection of human rights on Gestational Surrogacy. -- Abstract: This study aims to address the challenges that arise the protection of the human rights of people involved in surrogacy, also in the dimension of domestic law, public international law and private international law of States. Nowadays, in the subject of reference, we are faced with a delicate legal situation, where it is evident that there is a serious need, for regulation and protection of the human rights of the people involved in this practice. To begin, we will carry out an analysis of the fundamental rules in this area like: the best interest of the child, the interest of the pregnant person, sexual and reproductive freedom, family rights, and the right to identity, among others; which are enshrined in International Treaties and Conventions and in the National Constitutions of the different countries. Finally, we will refer to the European Court of Human Rights, emphasizing its relations and dialogue with the European national Courts, addressing the main jurisprudential antecedents on the matter. |
