| Sumario: | Family contracts in Polyaffecive Relationschips : Each family can create its own Family Law. --- Abstract: The current configuration of family and family law, in Brazil and in the world, has faced profound and intense changes, especially in the last two decades. Changes in theroles of family members, increased life expectancy, gender rediscussion, demographic changes, changes in privacy, resizing of sexuality, full female independence, advances in reproductive medicine and the constant and growing presence of technology in people's lives are just some of the factors that influence the contemporary Brazilian family. The new generations demand the construction of specific Family Law rules, respecting the options and peculiarities of each individual, as well as each family group. Therefore, the rules of coexistence must be defined by the couple or family group, instead of being imposed by the State. The kaleidoscope of the contemporary family is made up of less traditional relationships, based mainly on the affection and love involved, valuing individualities and real desires. Jean Carbonier's reflection, in the sense that ?each family is given its own Family Law?, makes us think, once again, of the role of the Modern State in the organization and preservation of the family structure.According to this reasoning, it would be possible to delimit the limits, possibilities and legal recognition of polyaffective families, especially their contractualization as a formof security and legal stability. |
