Sumario:Abstract: The principle of equal treatment and the principle of non-discrimination are fundamental to the European Union and are now widely developed in legislation. This paper will analyse European legislation on religious freedom, equal treatment and non-discrimination, specifically Directive 2000/78 on combating discrimination on the grounds of religion or belief, disability, age or sexual orientation in the field of employment or occupation. We will also analyse three judgments handed down by the Court of Justice of the European Union in which, for the first time, the issue of equal treatment and religious freedom in the field of employment was addressed and in which the Court had to establish the way in which Directive 2000/78 should be applied and interpreted. In conclusion, the final objective of this paper is to establish the Court of Justice's interpretation of these rights, as well as to be able to conclude in which cases it considers that there is discrimination in employment on religious grounds.
