| Sumario: | Title: Considerations on the legal nature of the Yogyakarta principles and their relevance to the Inter-American human rights system. Abstract: The author investigates about the legal nature of "The Yogyakarta Principles on the Application of International Human Rights Law to Questions of Sexual Orientation and Gender Identity" (YP), in order to evaluate if it may be considered part of the universe of soft law. In view of this, she develops certains fundamental concepts about the humanitarian issue in question, to then carefully scrutinize the content of that legal instrument and finally address the study of the main theorizations that delimit the spectrum of soft law. Once such a substrate has been established, we can detect an analysis of the effective and potential projections of the YP as a legal tool to guarantee the effective protection of the members of the LGBTIQA+ community, with special emphasis on its reception within the Inter-American Human Rights System. |
