Sumario:Title: Migrant minors who claim or are assumed to be refugees: they should immediately acquire refugee status. Abstract: This paper deals with the issues that arise in Mexico as a destination country, and that can undoubtedly occur in other latitudes too, regarding to the dangers to which accompanied or unaccompanied migrant children and adolescents are exposed. Concerning this matter, I will specify which are the main threats faced by this vulnerable group. Furthermore, I will show the importance of the constitutional reforms made on June 2011 regarding the "amparo action" and human rights in Mexico and some international standards, with the impact of both on the human rights of migrant minors. I will show standards of the Mexican Supreme Court regarding the protection of the best interests of the minor in all administrative and jurisdictional activities. Finally, based on the legal framework that protect migrant children and adolescents human rights, and the evident delay of the administrative authorities in the procedure for the recognition of their refugee status which leaves them exposed to many dangers, I will propose a solution so that they can immediately have access to the rights and absolute protection of the State.
