| Sumario: | Title: Multilevel protection in the Charter of Fundamental Rights of the European Union: How to interpret Article 53? Abstract: this article deals with the problematic relationship between legal orders in the EU arising from the multilevel protection of rights. Concentrating on the relationship between the Court of Justice and the Spanish and Italian Constitutional Courts, it focuses on the Melloni dilemma and its projection in the Taricco saga. It explores the central importance of Article 53 (CFREU) for the construction of a system of EU rights based on the minimum consensuses that allow for a dialogue between Courts. It raises the need for a primacy of the EUD integrated with the common constitutional traditions mentioned in Article 4(2) (TEU). |
