Sumario:Abstract: Equality Act 27.412 establishes a gender quota, which requires 50% female representation and alternation of male and female candidates on a ballot paper. However, the gender-equality principle of "no submission" recognizes women as a group whose rights to political representation had been disregarded and implemented affirmative action measures tending to improve their standing. Therefore, the recent recognition of gender neutrality by the different administrative and judicial bodies prompts us to re-evaluate the concept of equality from a different perspective and to consider how the quota system should study the possible incorporation of non-binary candidates. This reassessment must take into account that the issue of "equality" entails avoiding distinctions and maintaining equal representation on the ballot paper, while keeping in mind that the principle of "no submission" will aim to find a solution in favor of the groups whose rights to political representation have been curtailed; these groups include women, and also possibly, non-binary individuals.
