Sumario:The Mercosur was conceived for a world that doesn't exist anymore. It's possible to see that the competition between the US and China runs in a scenery which is formed by different "chessboards" where they can settle "rounds" of geopolitic, military, economic, technologic, cultural content at the same time. Considering the importance of the extrazone issues that they have always had about determinating the action courses of Latin American integration, there are incentives to adjust the legal and institutional order of Mercosur to the challenges of the new context. In this article we are going to analyze how far the Asunción Treaty has become obsolete and how this Treaty impacts the unfinished development of the customs union in the implementation of the agreements that Mercosur signs with third states.
