| Sumario: | This paper intends to make an explanation of how Brazilian superior courts have defined the law applicable to the international air transportation. The first part of this paper demonstrates that, in the 90s, the precedents of Brazilian Superior Courts started to deny the application of air transportation international conventions and decided that national law should prevail, regardless whether the case was about passengers or cargo. The second part of this paper shows that, in the last two years, Brazilian Superior Courts made a turn and are now applying air transportation international conventions in the international transportation of cargo and that Brazilian Supreme Court is about to rule two important cases related to international transportation of passengers. This paper deals only with the back and forth movement of Brazilian Superior Courts' decisions on international air transportation, since the legal issues raised by international air transportation are more diverse, than those related to national air transportation, in which case the discussion is limited to the antinomy of Consumer Code and Brazilian Aeronautical Code. |
