| Sumario: | The problem of international child abduction has been of primary concern for the international legal community and, considering the aim to ensure children's contact with their parents and to guarantee the stability of their family ties, a mechanism to attain their prompt return has been designed. In this paper, the cornerstones of its proper functioning will be enunciated and the provisions incorporated by the new Civil and Commercial Code of Argentina on the subject will be analyzed. Finally, the achie- vements and remaining challenges of international return of children processes in our country will be highlighted through the analysis of recent national case-law. |
