Sumario:The purpose of this paper is to briefly analyze the reform introduced by the Government in the Spanish Aliens Act with the purpose of providing legal coverage to practices popularly known as "hot returns", through which the Forces and Bodies of State Security expel, in an expeditious manner and without respecting the procedures and legal guarantees, the foreigners to Moroccan territory in the South Spanish border, evidencing the violation of the most basic norms of international protection of refugees and human rights. To this end, we will analyze the legal reasons on which the Spanish Government seeks to support the legality of such practices, such as rejection at border and the operational concept of border, to then delve into the reasons that lead us to conclude that these practices do not only breach Spanish and European legislation but also international law, both regional and universal.
