| Sumario: | Based on what was recently established by the Yogyakarta Principles +10, the aim of this paper is to address how the right to create a family -in light of reproductive technologies and access to them regardless of sexual orientation and gender identity- has led to the deconstruction of biology and roles, such that it is nowadays practically impossible to continue talking about maternity and paternity. These terms come from a binary that no longer exists, not only in terms of sex and gender but also in terms of relationships, which is why they appear obsolete today. To define the person who is raising a child as mother or a father is a forced operation, since the categories enabled such a determination have collapsed. This work seeks to demonstrate that if our legislation considers the "role" that is ultimately assumed as an identity issue, where neither sex, nor biological or genetic contributions matter to define such role, then it is possible to question whether that role actually matters. What defines those roles? Now more than ever, they are obviously political constructions based on cultural foundations that must be deconstructed. To that end, it is fundamental to suppress sex as a legal category. |
