| Sumario: | This article, which is within my master's thesis, comprises three sections. The first section will present a genealogic approach to the Gender Identity Act by underlining various court scenes, which were chosen on a chronological basis and which are subject to an addition and subtraction game that operates on the free expression of. Each scene will be presented through critical lenses, with the purpose of envisaging the form, mechanisms and premises underlying the Gender Identity Act, conceived as a category within the "subject of rights" concept. Additionally, the piece will highlight who were the parties authorized to speak during court rituals, and which relationships were established in the construction of new subjectivities, following the hypothesis according to which the biomedical model of psychiatric-diagnosis -in the context of a power agreement with the judicial branch- coined normative definitions of sexual differences; texts and contexts in which voices overlapped with knowledge-power relationships within the legal discipline. The second part will propose how to interpret and apply the law with a rights-based approach (from a global south perspective). Finally, it will present certain challenges related to the potential sustainability of the sex marker in official documents. |
