Law and Democracy, Rio de Janeiro, 2009, pp. 1-18 [Editors' note: References to keywords appear in parentheses and are highlighted in italics in the text. These references are cross-references to other articles written by other authors and published in the same volume in which the author is one of the editors. Although these articles do not appear in the present issue of Academia, we have included the references because they illustrate the connections the author intends to make with other topics]." -- The aim of this paper is to present the most significant currents of thought that have characterized critical theory from its origin in the heart of the Frankfurt School up to the present. First, the author portrays the classical stage of critical theory from research carried out by Horkheimer, Marcuse and Adorno. Then, he seeks to analyze the inclusion of the normative dimension as the object of study by Neumann and Kirchheimer and the influence of Habermas's discursive theory in the development of critical theory. Furthermore, he states the main objections that are made by critical theoreticians about positivist legal philosophy, especially in regard to Public International Law, and presents proposals for new critical approaches. |
