Sumario:The objective of the present work is to reflect on the different approaches that exist towards the legal capacity of people with disabilities in the teaching and learning process in Law Schools. In the First and Second Parts, the enquiry concerning the topic is rebuilt from the analysis of the civil codification and the scholarly works that are generally used for the study of this topic, in order to identify the perspective that they adopt about the disability: this is the "medical model". Next, in the Third Part, a similar reflective exercise is done about the Convention on the Rights of Persons with Disabilities, which presents a different approach about the topic: the "social model". The Convention, being part of the current legal system, demands a profound revision in addressing the issue of the legal capacity of the persons with disabilities, and invites to dialogue between Private Law and Human Rights.
