| Sumario: | My goal in this article is to differentiate and to identify, with some semantic precision, the various and confusing ways in which the terms "ius-naturalism", "ius-positivism" and "critique" are used. First, I will show the uncomfortable polysemy of these terms. Then, I will suggest a change of vocabulary to avoid the tiring controversies created by these terminological confusions in the academic areas of law. Finally, and in a subsidiary way, I intend to show the compatibility and complementarity between a program of a Radical Critique of Law and the Kelsenian conceptualization of the State and the law. |
