| Sumario: | This paper aims to enquire into the institutional role assumed by the Supreme Court of Justice when faced with a possible fail in the functioning of representative democracy. To this end, we aim to compare the function fulfilled by the highest federal court in recent electoral controversies, where the interpretation of the rules of the game stemming from the constitutions of the individual provinces may affect the representative, republican principles of the Federal Constitution. For this reason, we plan to profile the different models of judicial review adopted by the Supreme Court on these matters, and identify the one that best embodies the principles and rules of a representative democracy. |
