Sumario:The determination of direct jurisdiction for legal relations with relevant foreign elements occupies a central place within the object of Private International Law. This can be reflected in the provisions included in the Civil and Commercial Code where we have not only rules that establish general principles, but also special provisions for each subject of the so-called Special Part. When determining jurisdictional contacts, the legislator selects those which contain a sufficient and reasonable connection with their judicial authorities and thus avoid exorbitant forums. There is a peculiar contact, such as the domicile of the plaintiff (forum actoris) that entails innate complexity: in some cases, it can be considered as a fair and necessary alternative to guarantee legitimate access to justice, while in others it can open to forums exorbitant. In this paper we propose to analyze the scope of this forum within Argentine Private International Law since the enforcement of the CCCN.
