Sumario:The Nagoya Protocol on access to genetic resources and fair and equitable sharing of benefits United Nations World Summit on Sustainable Development (WSSD) was held in 2002 in Johannesburg, South Africa. "Johannesburg Implementation Plan" was adopted, including different references to access and sharing of benefits of biological diversity (ABS). Among others, the international community called for action to negotiate an international regime to promote fair and equitable sharing of the benefits derived from the use of genetic resources, within the framework of the Convention on Biological Diversity (CBD) The Nagoya Protocol is an international agreement adopted within the Convention on Biological Diversity, which aims to provide a legal framework for the effective application of one of the three objectives of this agreement. The issues of prior informed consent and mutually agreed terms will be analyzed. The Nagoya Protocol was approved by Law 27.246 and it was ratified on December 9, 2016. Recently, Argentina issued Resolution 410/2019. It establishes the requirements to obtain authorization on access to genetic resources. The challenge of implementing ABS through Resolution 410/2019 is an approach to show that ABS is not only an abstract concept, but a system that works and really constitutes an incentive to sustainable use of biodiversity and the development of capacities in developing countries.
