| Sumario: | As hinted in the title, this is an analysis of how the elements of a contract work in Argentina, where the Civil-Law legal system of construction of contracts is in force. These elements are agreement, subject matter and causa. For us, this article is an initial step in developing a hybrid teaching system that balances theory and practice, as a response to our noticing that many students have difficulties when applying theoretical knowledge. Being an initial step, this article is mainly theoretical. The difference with other theoretical articles in this topic, which are mainly focused on definitions, is that we dwell on how these elements work and how they relate with the different institutes of contract law. From that standpoint, we will explain the elements of contracts, its constituents, and how do institutes of contract law to these elements. We will also address current issues like e-contracts and over indebtedness. |
