Descripción
Sumario:This research aims to look at electoral jurisdiction from a political perspective, i.e., not strictly juridical, to gain a better understanding of the role of the electoral judge as one participant among the many in a democratic political system. This investigation places special emphasis on the electoral judge´s intervention in the resolution of conflicts of political and social nature. To this end, it examines the role of the electoral judge and their quasilegislative political function with the aim of establishing the reach, validity and effects of the sentences passed by these courts in exercise of their powers of defending the supremacy of the constitution and deciding on matters of importance to representative democracy. Even though the interpretative aspect of the Electoral Justice system covers many areas, this research focuses on a series of rulings related to electoral federalism, the representative democracy, political rights, and the transparency of the electoral process.
