| Sumario: | We present some conclusions of the research project that deals with the judicial application in the City of Buenos Aires of the Law 26.657 on Mental Health in the proceedings that involve the determination of civil capacity, regarding: a) the legal capacity of the person during the proceedings; b) the criteria to integrate interdisciplinary teams and its functioning; c) the contents and scope of the judicial ruling restricting civil capacity; and d) the proceedings to review the judgement. The study was conducted within the framework of the Convention on the Rights of Persons with Disabilities (Law 26.378 with constitutional hierarchy by Law 27.044) and considering the issues raised by the Mental Health Act, the judicial practice in civil capacity and its projections in relation to the Civil and Commercial Code (Law 26.994). |
