Sumario:My aim in this paper is comment the case "Bignone..." ruled by the Corte Surpema de Justicia de la Nación. In the text I try to show technical flaws of the decision and identify the general weakness of its justification. In addition, I try to show that in Muiña, the CSJN decision seeks to retake some aspects of the Simón ruling and attempt to close many of the issues associated with our turbulent past through what I have called "forced institutional reconciliation".
