| Sumario: | This paper will address the contradiction in countries like Argentina, where there is no legal regulation of pregnancy by substitution, but it recognizes the international affiliation derived from the techniques of assisted human reproduction. In this regard, I will address the problems arising from this contradiction and issues that are involved in the recognition of the filiation, particularly when it comes to its international aspect. However, I chose to use an approach that has as its center the child, using as guiding principles the International Law of Human Rights. Finally, advancing conclusions, I will argue the urgent need for a certain and defined legislation that gives legal certainty to the situation of children born through gestation substitution. As well as a more complete content of the "best interest of the child" in regard to pregnancy by substitution. |
