Sumario:The aim of this work is to establish a critical look at the implementation of the accusatory system in the new National Code of Criminal Procedure, in the light of the rules of availability of the action, in particular in the light of the introduction of criminal conciliation. The comprehensive approach to the issue requires review the terms in which a judicial system can be called accusatory and position that should be occupied by the victim. Furthermore, it is necessary to analyze how the restrictions imposed on the procedural implementation of the new institutes tend to mere regulation or distort its role in the adversarial procedure. To reach this objective it is necessary to study how those limitations would affect victims of domestic violence or discrimination motivated, and analyze the convenience (or inconvenience) of its application.
