Sumario:The author analyzes the importance of judicial argumentation and holds that the duty to justify judgments is a key element of the rule of law and the republican system. The period analyzed ranges from 1810 to 1838, in Argentina. The article draws a connection between the ideas of the Age of Enlightenment and of Rationalism of the 18th century. Following a thorough analysis of historical events, the author finishes with the fortunate paradox of Argentine legal history - the first statutorily - imposed requirement to justify judgments, enacted under a tyrannical regime
