Sumario:The aim of this work has been to clarify part of the theoretical background of Habermas' conception of democracy, namely, his consensual theory of truth and rightness. This work has been specially thought both as a teaching aid and a reflection resource for law students who, interested in theory of democracy, want to delve into the foundations of the discursive theory of deliberative democracy.\nIt´s structured in three sections: the first one gives a conceptual and historical demarcation of the "theory of the deliberative democracy" (I); second section attempts to elucidate Habermas´ consensual theory of truth and rightness, taking his article "Truth Theories" (1972) and the idea of an "ideal speech situation" (II).\nThat, in order to finally show why it is one of the basic philosophical cores to understand the legitimating role of the public, democratic and deliberative formation of the opinion and political will (III)
