| Sumario: | The confusing collapse of the Fourth Republic led to the reappearance of Charles de Gaulle in\nthe French political scene. The Constitution of the Fifth Republic was therefore originated and immersed\nin a deep political and institutional crisis resulting from the Algerian War. As a consequence of the\nopposing influence of two leading characters closely related to General De Gaulle, i.e. Michel Debré and\nRené Capitant, the then new Constitution implied political tensions which had to be solved by political\nactors, especially by the President of the French Republic.
