| Sumario: | This paper proposes the design of a type of equality analysis that goes beyond\nthe inadequacies of the traditional formal and material formulas as non discriminatory\nprinciple. To that effect, the authors deal with the concept of equality as non domination\nand integrate it with the approach of Nancy Fraser's theory of redistribution\nand recognition. Afterwards, the article accounts for this type of exam applied to the\nre-interpretation of the new paradigmatic cases subjected to the control of the InterAmerican\nCourt of Human Rights.
