Sumario:In the case '"Arriola, Sebastián and others", almost 23 years after ruling in\n"Bazterrica, Gustavo Mario about possession of drugs", the Federal Supreme Court\nof Justice again declared the unconstitutionality of the crime of possession of drugs\nfor personal consumption. Nevertheless, does the Court return to the position adoptedin Bazterrica regarding the protection of autonomy (Art. 19 FederalConstitution)? Or\ndoes it protects it in a more measured way? Or, on the contrary, in a more robust fashion?\nOn this paper, this last reading is adopted, based on Arriola's reliance on Judge\nPetracchi's opinion in Bazterrica - which is even more liberal than the majority opinion -.\nThe reading of the scope given in Arriola to the principle of autonomy certainly\nis in accord with the idea of democratic equality
