Nevertheless, does the Court return to the position adoptedin Bazterrica regarding the protection of autonomy (Art. 19 FederalConstitution)? Or\ndoes it protects it in a more measured way? Or, on the contrary, in a more robust fashion?\nOn this paper, this last reading is adopted, based on Arriola's reliance on Judge\nPetracchi's opinion in Bazterrica - which is even more liberal than the majority opinion -.\nThe reading of the scope given in Arriola to the principle of autonomy certainly\nis in accord with the idea of democratic equality |
