However, the pending reform of the Code allows the newborn\nchild to have access to the medical data of the donor when there is a risk to her health.\nThe donor?s identity may be even revealed under well founded reasons that will be\nconsidered by the judicial authority. The purpose of this paper is that of exploring the\nproportionality of the proposed law from the optic of the child?s right to her identity.\nThis analysis demands a differentiation between the legal action of constituting a legal filial bond and the access to one?s origins. Sin embargo, reconoce\nal nacido la posibilidad de acceder a la información relativa a los datos médicos del\ndonante cuando hay riesgo para la salud, y la eventualidad de que se revele su identidad\npor razones debidamente fundadas, que seran evaluadas por la autoridad judicial.\nEl objetivo de estas líneas es explorar la proporcionalidad de las normas proyectadas\ndesde el punto de vista del derecho a la identidad del hijo.
