Sumario:The proposed amendment to the Argentine Civil and Commercial Code rejects\nthe legal appropriateness of the actions of affiliation in the cases where the child\nin question has been conceived by Assisted Human Reproduction (AHR) if there has\nbeen previous consent of those individuals who have voluntary assumed the assisted\nprocreation process. However, the pending reform of the Code allows the newborn\nchild to have access to the medical data of the donor when there is a risk to her health.\nThe donor?s identity may be even revealed under well founded reasons that will be\nconsidered by the judicial authority. The purpose of this paper is that of exploring the\nproportionality of the proposed law from the optic of the child?s right to her identity.\nThis analysis demands a differentiation between the legal action of constituting a legal filial bond and the access to one?s origins. These are indeed two different autonomous\naspects in the framework of complex variables brought about by this human right
