The testimonies presented in these lawsuits show a recurrence in the arguments (time, use, reason and strength) that merit a technical analysis of these references. The aim of this paper is to analyze the references to fuerça e syn razón in the statements of witnesses as discursive juridical strategy for the acquisition of rights. With this objective will explore the link between these arguments and the legal definitions of dominium and ius consuetudinarium of ius commune. La documentación del Asocio de la ciudad de Ávila y sus pueblos es un acervo documental más que rico para un análisis de los procesos judiciales que se desarrollaron en Castilla a partir del siglo XV en torno del problema de la apropiación de los terrenos comunes. Los testimonios expuestos en estos pleitos muestran una recurrencia en los argumentos (tiempo, uso, razón y fuerza) que ameritan un análisis técnico de estas referencias. Este artículo tiene por objetivo analizar las referencias a la fuerça e syn razón en las declaraciones de los testigos como estrategia jurídico discursiva para la adquisición de derechos.
