During 2018 and 2019, the highest court of the Republic allocated significant sums of public economic resources to the execution of a project called “Modernization of the technological platform of the Supreme Court of Justice”, however, said website throughout the year 2020 has not been working properly. This situation, on the occasion of the COVID-19 pandemic and the measures of social distancing and mandatory quarantine imposed by the Venezuelan State, has generated the violation of the rights of access to justice and effective judicial protection of citizens, who cannot rely on technological mechanisms to monitor judicial matters during the period of confinement. For this reason, the role of the Venezuelan fiscal control bodies as guarantors of the proper use of public resources and the impact this has on the enjoyment of citizens' rights, can generate an inappropriate exercise of fiscal control activity is analyzed. En el presente artículo se reflexiona sobre el impacto del inadecuado ejercicio del control fiscal en el disfrute de los derechos de los ciudadanos a través del estudio de un caso concreto: la falta de funcionamiento de la página web del Tribunal Supremo de Justicia de Venezuela. Durante 2018 y 2019 el máximo tribunal de la República destinó sumas importantes de recursos públicos a la ejecución de un proyecto denominado “Modernización de la plataforma tecnológica del Tribunal Supremo de Justicia”, sin embargo, dicho sitio web durante el año 2020 no ha funcionado correctamente. Esta situación, con ocasión a la pandemia de COVID-19 y las medidas de distanciamiento social y cuarentena obligatoria impuestas por el Estado venezolano, ha generado la violación de los derechos de acceso a la justicia y tutela judicial efectiva de los ciudadanos, quienes no cuentan con mecanismos tecnológicos que permitan hacer seguimiento a los asuntos judiciales durante el período de confinamiento. En razón de ello, se analiza el rol de los órganos de control fiscal venezolanos como garantes del adecuado uso de los recursos públicos y el impacto que, en el disfrute de los derechos ciudadanos, puede generar un inadecuado ejercicio de la actividad de control fiscal.
