A restriction of a right takes place every time an action by the State denies or prevents the right holder from exercising it in accordance with the full extent of the fact that the right is actually assumed. So, the most important element for a human right to be validly restricted is proportionality, no matter how restricted it is, by which authority, by which authority, or by which legal discipline, or which type of fundamental right; that is, it cannot be automatically restricted, but steps must be taken to justify proportionality and to be tested, as well as facts which, in addition to the test, permit validly restrict it (Barak, 2017: 664). La restricción de Derechos Humanos implica su operatividad desde otros rubros; es decir, no su eliminación, sino la aplicación de un derecho bajo ciertos pasos legales que son la fórmula para su aplicación de acuerdo con las bases de legitimidad y legalidad. De esta forma, una restricción de un derecho implica que el Estado deniega o impide que el titular del derecho lo ejerza de acuerdo a la plenitud del supuesto de hecho de dicho derecho. Por lo cual, el elemento más importante para que un Derecho Humano pueda ser restringido válidamente es la proporcionalidad, no importa la forma en que sea restringido, ni por cual autoridad, ni en qué disciplina jurídica, ni qué tipo de derecho fundamental; es decir, no se puede restringir automáticamente, sino que deben llevarse a cabo pasos que justifiquen la proporcionalidad y existir pruebas, así como hechos que, además del test, permitan válidamente restringirlo (Barak, 2017: 664).
